Technology competence is now a requirement for all lawyers and an ethical issue. In 2012 the ABA House of Delegates voted to amend Model Rule of Professional Conduct 1.1 comment [8] (Maintaining Competence) as follows: “To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology, engage in continuing study and education and comply with all continuing legal education requirements to which a lawyer is subject.” With this resolution technology competence has moved from optional to mandatory.
On March 28, 2015, the New York State Bar Association adopted a version of the ABA’s Comment 8. It says that: [8] To maintain the requisite knowledge and skill, a lawyer should (ii) keep abreast of the benefits and risks associated with technology the lawyer uses to provide services to clients or to store or transmit confidential information, and (iii) engage in continuing study and education and comply with all applicable continuing legal education requirements under 22 N.Y.C.R.R. Part 1500. Tech Up for Women Conference is an event where lawyers can attend technology programs that will focus on new technology advances, cyber security and technology products that will educate lawyers to demonstrate technological competency in the practice and business of law for the clients they represent.
